Petition under Section 438 Cr.P.C.

According to the petitioner, he is apprehending arrest in connection with Crime No.917/2014 of the Kasaragod Police Station for the offences punishable under Sections 341, 323 and 498A IPC. The learned Public Prosecutor has pointed out that the investigation in this case is over and Final Report has already been filed by the investigating officer before the Chief Judicial Magistrate's Court, Kasargod. Matters being so, it is for the petitioner to surrender before the court below and seek regular bail. In such case, the Court below shall dispose of the application preferably on the same day itself, provided, advance notice is served on the Assistant Public Prosecutor in charge of the case.
