O R D E R
The petitioner is the 2nd accused in Crime No.2121/2014 of Thodupuzha Police Station registered under Section 304 B read with Section 34 I.P.C.
2. The prosecution allegation is that on 26.12.2014 at 12 noon, the wife of the first accused Meenu @ Shahina committed suicide by hanging. On the basis of the statement given by the father of the deceased, the above crime was registered.
3.The petitioner has filed this application praying for the relief under Section 438 Cr.P.C.
4. Heard.
5. The learned Public Prosecutor has no serious objection in allowing this application.
6. The first accused in the crime was the husband of the deceased. The petitioner was the mother-in-law of the deceased. The first accused was already arrested by the police in connection with this case. Considering the facts and circumstances of the case, including the fact that the petitioner is the mother-in-law of the deceased, I am of the view that an order under Section 438 Cr.P.C. in favour of the petitioner will be justified in this case. In the result, this application stands allowed and
the respondent is directed to release the petitioner on bail in the event of her arrest in connection with Crime No.2121/2014 of Thodupuzha Police Station on condition of the petitioner executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties, each for the like sum to the satisfaction of the Sub Inspector of Police, Thodupuzha police station, before whom the petitioner shall surrender within ten days from today and subject to the following conditions:
(i) The petitioner shall report before the Investigating Officer as and when required by the Investigating Officer for interrogation.
(ii) The petitioner shall not intimidate or influence the witnesses or in any way tamper with
the investigation.
(iii) The petitioner shall not get involved in any offence while on bail.
