Petition filed under Section 439 Cr.P.C.

Petitioner is the first accused in Crime No.3858/2014 of the Kodungallur Police Station, Thrissur registered for the offences punishable under Sections 379 and 411 read with Section 34 of the Indian Penal Code. 3.

The allegation against the petitioner is that during the 3rd week of November, 2014, he along with the 2nd accused, came by a motorbike and snatched away gold chain weighing 21⁄4 sovereigns, from the neck of the defacto complainant woman. The petitioner has been in custody for the period from 01.01.2015 onwards.

Heard learned counsel for the petitioner and the

B.A.No.1480 of 2015 -: 2 :- learned Public Prosecutor.

The learned Public Prosecutor has pointed out that the petitioner is a habitual offender involved in cases relating to chain snatching from the neck of various women, and over and above the present case, he is accused in four more cases of similar nature. The learned Public Prosecutor has also pointed out that final report in the matter has been filed on 28.01.2015. Considering the seriousness of the allegations against the petitioner and the series of serious criminal antecedents on his part, I am of the view that the petitioner is not entitled to be enlarged on bail.
