Petition filed under Section 439 Cr.P.C.

Petitioner is the first accused in O.R. No.1/2014 of the Narcotic Control Bureau, Sub Zone, Cochin registered for the offences punishable under Section 20(b)(ii)(c), 28 and 29 of the Narcotic Drugs and Psychotropic Substances Act,1985.

The allegation against the petitioner is that he was found transporting 25 kgs. of ganja, in contravention of the provisions of the NDPS Act, 1985, thereby he has committed the aforesaid offences. Petitioner has been in custody for the period from 24.07.2014 onwards.

Heard learned counsel for the petitioner and the learned Standing Counsel for the respondent.

It seems that this is a case wherein commercial quantity of ganja is involved. Final report in the matter has been filed on 19.01.2015. The petitioner is hailing from the State of Orissa. Considering the seriousness of the allegations against the petitioner and the gravity of the offence involved, I am of the view that the petitioner is not entitled to be enlarged on bail.
