ORDER
The petitioners are accused Nos.4 and 8 in Crime No.752 of 2014 of New Mahe Police Station, registered under Sections 143, 147, 148 and 332 read with Section 149 of the Indian Penal Code.
2. The petitioners have filed this application under Section 438 of the Code of Criminal Procedure.
3. Heard.
4. The learned Public Prosecutor has no serious objection in allowing this application. It has been submitted by the learned Public Prosecutor that this Court had already granted relief under Section 438 Cr.P.C., in favour of accused Nos.1, 3, 5 and 7 as per order dated 18.02.2015 in B.A.No.719 of 2015. Since the petitioners are also similarly placed, I am of the view that it is only just and proper to grant the same relief to the petitioners as well.
5. In the result, this bail application stands allowed and the respondent is directed to release the petitioners on bail in the event of their arrest in connection with Crime No.752 of 2014 of New Mahe Police Station on condition of each of the petitioners executing a bond for Rs.25,000/- (Rupees Twenty
B.A.No. 1580 of 2015 five thousand only) each with two solvent sureties each, each for the like sum to the satisfaction of the Sub Inspector of Police, New Mahe Police Station before whom the petitioners shall surrender within ten days from today and subject to the following conditions:
1. The petitioners shall report before the Investigating Officer on every Monday between 9 a.m. and 11 a.m. for six months or till the filing of the final report, whichever is earlier.
2. The petitioners shall not intimidate or influence the witnesses or in any way tamper with the investigation.
3. The petitioners shall make themselves available for interrogation as and when required by the investigating officer.
4. The petitioners shall not get involved in any offence while on bail.
