Petitioners are accused Nos.15 and 16 in Crime No.1048/2014 of Kasaragod Police Station registered for the offences punishable under Sections 143, 147, 148, 341, 449, 120B, 153A and 302 read with Section 149 of the Indian Penal Code.

The allegation against the petitioners and other accused is that on 22.12.2014 at 9.45 p.m., they formed themselves into an unlawful assembly armed with deadly weapons and committed house trespass into the shop of the de facto complainant and attacked the son of the de facto complainant, who was in the shop, and stabbed him to death. The petitioners have been in custody for the period from 06.01.2015 onwards.

Heard learned counsel for the petitioners and the learned Public Prosecutor.

Even though the petitioners have been in custody for the period from 06.01.2015 onwards, the investigation is not over and the final report has not been filed so far. Matters being so, this is a case wherein the petitioners are entitled to compulsive bail under Section 167(2) Cr.P.C. 6.

In the result, this Bail Application is allowed and the petitioners shall be enlarged on bail on each of them executing a bond for ₹1,00,000/-(Rupees one lakh only) with two solvent sureties for the like sum each to the satisfaction of the concerned Judicial First Class Magistrate's Court, and subject to the following terms and conditions:- (i) The petitioners shall report before the Investigating Officer in between 9 a.m. and 11 a.m. on all Mondays and Thursdays, commencing from 13.04.2015 for a period of six months.

(ii) Except for observing condition No.(i) above, the petitioners shall not enter into Kasaragod district for a period of six months from today.

(iii) The petitioners shall not tamper with the evidence or influence witnesses.

(iv) The petitioners shall make themselves available for interrogation as and when required by the Investigating Officer.

(v) The petitioners shall not involve in any offence while on bail.

It is made clear that the violation of any of the conditions stipulated above will result in the cancellation of bail.
