Petition filed under Section 438 Cr.P.C.
2.Petitioner in each of the above cases is alleged to have committed the offences punishable under Section 379 of the Indian Penal Code and Sections 20 and 23 of the Kerala Protection of River Banks and Regulation of Removal of Sand Act, 2001. The prosecution case is that, the petitioners were found transporting river sand without any permit or other licence.
3.Heard both sides.
4.The materials relied on by the prosecution indicate involvement of the petitioners in the commission of the offences. The offences committed by them are of very serious in nature. The court cannot lightly view plunder
