Petition filed under Sec.438 Cr.P.C.
2. It is submitted that the 2nd petitioner is no more. The petitioner along with the co-accused is alleged to have committed the offences under Sec.420, 468 and 471 read with Sec.34 of Indian Penal Code. The prosecution case is that on the strength of forged documents they obtained sales tax registration in the name of the petitioner and caused a huge loss to revenue.
3. Heard both sides.
4. Learned counsel submits that the incident took place in 1997. That is not relevant. Commission of the offence came to light only in 2004.
5. The nature of the case demands custodial interrogation of the petitioner. This is not a fit case to grant anticipatory bail.
