O R D E R

The petitioner is the 14th accused in Crime No.147/2013 of Perumbavoor Police Station, registered under sections 143,145,147,148,332,283,151,153,153(A) read with Sec. 149 IPC, Sections 4 & 5 of Kerala Public Ways (Restriction of Assemblies and Process) Act and Sec. 3 (1) of PPPP Act, 1984. The petitioner has filed this application under Section 438 Cr.P.C. 2.

Heard.

The learned Public Prosecutor has submitted that all the accused in the above crime, who approached this court, had been already granted the relief under Section 438 Cr.P.C. by this Court as per order dated 28.02.2013 in Bail Application No.1209/2013. Since the petitioner is also similarly placed, I am inclined to grant the same relief to the petitioner as well. In the result, this application stands allowed and the respondent is directed to release the petitioner on bail in the event of his arrest in connection with Crime No.147/2013 of Perumbavoor Police Station, on condition of the petitioner

B.A. No.2306 of 2015 executing a bond for `15,000/- (Rupees fifteen thousand only) with two solvent sureties, each for the like sum to the satisfaction of the Sub Inspector of Police, Perumbavoor, before whom the petitioner shall surrender within 10 days from today and subject to the following further conditions:

(1) The petitioner shall deposit Rs.1,000/- before the Sub Inspector of Police simultaneously at the time of surrender before him.

(2) The petitioner shall report before the Investigating Officer for interrogation as and when required.

(3) The petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.

If the petitioner deposits the amount as directed above, the Sub Inspector of Police concerned shall deposit the said amount before the Magistrate Court concerned on the same day.
