Petition filed under Section 438 Cr.P.C.

2. The petitioner is the accused in Crime No. 168 of 2015 of Bezhadukka Munnadu Police Station. The petitioner apprehends that he will be arrested by the police on the allegation that he has committed the offences under section 379 IPC and sections 20 & 23 of Kerala Protection of River Banks and Regulation of Removal of Sand Act. The prosecution version is that he was found transporting river sand without any permit or other documents.

3. Heard.

4. The petitioner was allegedly the driver of the vehicle, in which the river sand was being carried without any permit or other documents. On spotting the police, he allegedly ran away. There is a prima facie case against him. Having regard to the nature of the offences, it is not proper to grant him anticipatory bail.
