Petition filed under Section 438 Cr.P.C.

2. The petitioner is alleged to have committed the offences under section 379 IPC and sections 20 and 23 of Kerala Protection of River Banks and Regulation of Removal of Sand Act, 2001.

3. The prosecution case is that he was found transporting river sand without any permit or other documents.

4. Heard.

5. The petitioner was the Driver of the vehicle, in which river sand was being carried. The vehicle was involved in two other cases registered earlier. It is not proper to grant him anticipatory bail.
