Petition filed under Section 439(1) Cr.P.C.

Petitioner is the accused in Crime No.261 of 2015 of Manjeshwar Police Station registered for the offence under Section 55(a) of the Abkari Act. 3.

The petitioner was found transporting 24 bottles of IMFL each containing 750 ml and 48 bottles of beer each containing 330 ml. Learned counsel submits that as the petitioner has been in custody since 26.4.2015 he may be granted bail.

The application is opposed by the learned Public Prosecutor. The quantity of liquor seized from the petitioner discloses the purpose for which it was being transported. Prima facie, he has committed the offence alleged against him. There are no grounds to believe that he is not guilty or that he will not commit it again. He is not entitled to bail.
