Petition filed under Section 438 Cr.P.C.
2. Petitioner along with the co-accused is alleged to have committed the offences under sections 341, 323, 324, 326 and 34 IPC. The prosecution case is that at about 9.45 in the night on 21.03.2015, near a temple where a festival was going on they attacked the victim with a tube light and stone causing him serious injuries on his face.

4. Learned counsel submits that the allegations are false and in fact the police have registered a case against the victim and others as Crime No. 196 of 2015. The wound certificate of the victim shows that he sustained fracture of the nasal bone and the bone just below his left eye apart from some other injuries. Learned counsel submits that the petitioner did not use any weapon. That may be true. But, the FI Statement discloses that he took part in the assault. Common intention is evident. This is not a fit case to grant anticipatory bail.
