------------------------------------------- B.A.No. 2523 of 2015 ------------------------------------------- Dated this the 22nd day of May, 2015
ORDER
Petition filed under Section 439(1) Cr.P.C.
2.
Petitioners are accused in Crime No.26 of 2015 of Badiadka Excise Range registered for the offence under Section 58 of the Abkari Act. 3.
The petitioners were found transporting 142 bottles of IMFL each containing 180 ml brought from Pondichery..
4.
Heard.
5.
Learned counsel submits that the petitioners have been in custody since 24.4.2015 and they may be granted bail. They allegedly imported liquor from another State. The quantity is huge. The application is opposed by the learned Public Prosecutor. Prima facie, there are grounds to believe that they have committed the offence. I am not satisfied that if they are released on bail they will not commit it again.
In the result, this application is dismissed. K.ABRAHAM MATHEW JUDGE pm
