Petition filed u/s.439 Cr.P.C.

2. Petitioner is alleged to have committed the offence under section 55(a) and (i) of the Kerala Abkari Act. At 10.25 a.m. On 17.04.2015, she was found to be in possession of 3.5 litres of Indian Made Foreign Liquor which according to the prosecution was kept for sale. The Liquor and a glass were seized from her. Learned counsel submits that taking into account the period of custody she may be granted bail.

3. The application is opposed by the learned Public Prosecutor who submits that she was detained under the KAAPA Act and she is on the rowdy list of the Police Station concerned. Final report has already been filed. In these circumstances, granting bail to the petitioner will adversely affect the interests of the society.

In the result, this application is dismissed. Sd/- K. ABRAHAM MATHEW, JUDGE DST //True copy// P.A. To Judge
