ORDER
Application filed u/s.439(1) Cr.P.C.
2. Petitioners are accused 1 and 2 in O.R. No. 1/2015, registered by the Directorate of Revenue Intelligence, Calicut. They allegedly imported 17.25Kg of gold from a foreign country without any authority. Learned counsel submits that they have been in custody since 19.03.2015 and they may be granted bail.
3. Heard.
4. The petitioners will be entitled to statutory bail within a few days. Investigation may not be completed immediately. In these circumstances, I am inclined to grant their prayer for bail.
B.A. No. 2596 & 2597/15
5. In the result, these applications are allowed.
1. Petitioners will be released on bail on their executing a bond for Rs.1,00,000- (Rupees One lakh only) each with two solvent sureties each for the like sum to the satisfaction of the lower court concerned. 2.The petitioners shall appear before the investigating officer on every Tuesday between 10.30 a.m and 11.30 a.m until further orders.
3. Petitioners shall surrender their passport before the investigating officer within five days of their release.
4. Petitioners shall not leave India without the previous permission of the court concerned.
5. They shall not get themselves involved in any other case involving economic offences.
6. They shall not attempt to destroy evidence, nor shall they attempt to influence the witnesses. In case of violation of any of the conditions, the court below is empowered to cancel the bail.
