O R D E R

---------------- Petition filed under Section 439 Cr.P.C.

2. Petitioner along with the co-accused is alleged to have committed the offences under Secs.143, 147, 148, 452, 506(ii) and 427 read with Sec.149 of the Indian Penal Code. The allegation is that he along with the co-accused, armed with deadly weapons like iron rods, trespassed into the house of the first informant, threatened to cause his death and caused damage to his house.

3. Heard both sides.

4. The petitioner has been in custody since 07.04.2015. He was in judicial custody in connection with another case. His formal arrest in this case was recorded on 07.04.2015. His further detention is not necessary for completion of investigation.

In the result, this bail application is allowed.

1. The petitioner will be released on bail on his executing a bond for 25,000/-(Rupees twenty five ₹ thousand only) with two solvent sureties each for the

B.A. No.2648 of 2015 2 like sum to the satisfaction of the learned Magistrate concerned.

2. He shall appear before the investigating officer between 11 a.m and 12 noon on all Tuesdays for three months, or till the final report is filed, whichever is earlier.

3. He shall not threaten or attempt to influence the witnesses, nor shall he, get himself involved in any criminal case.

4. He shall not destroy or attempt to destroy the evidence.

If the petitioner violates any of the above conditions, the court of enquiry/trial is empowered to cancel the bail in accordance with the law.
