O R D E R

Petition filed under Sec.438 Cr.P.C.

2. Petitioner is alleged to have committed the offences under Secs.323, 354, 427, 506 and 294(b) read with Sec.34 of Indian Penal Code. The prosecution case is that the motorcycle on which he was travelling hit at the back of the car in which the first informant was travelling. At the place of occurrence the petitioner uttered obscene words, outraged the modesty of the first informant and threatened her and her brother.

3. Heard both sides.

4. The first informant did not sustain any injuries. It appears that this case arose from the motor accident that happened at the place of occurrence.

5. Having regard to the nature of the case it appears that custodial interrogation of the petitioner is not necessary in this case.

In the result, the bail application is allowed.

1) The petitioner shall be released on bail after interrogation on his executing a bond for Rs.25,000/- (Rupees Twenty five thousand only) with two solvent sureties each for the like sum if he is arrested by the Police in connection with this case.

2) He shall deposit Rs.3,000/- (Rupees three thousand only) in the Trial Court concerned within five days.

3) He shall appear before the investigating officer between 10.00 a.m and 11.00 a.m. on every Friday for three months, or till the final report is filed, whichever is earlier.

4) He shall not destroy or tamper with evidence.

In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with the law.
