The petitioner is alleged to have committed the offence under Sections 379 of Indian Penal Code and Section 20 and 23 of Kerala Protection of River Banks and Regulation of Removal of Sand Act.

The prosecution case is that he was found transporting river sand in a vehicle without any permit or other authority.

The materials relied on by the prosecution prima facie, disclose commission of the offence by the petitioner.
