Petition filed under Sec.438 Cr.P.C.
2. Petitioner is the accused in Crime No.514 of 2015 of Puthoor Police station registered for the offence under Sec.308 of Indian Penal Code. The prosecution case is that the first informant who found consuming liquor in the courtyard of the house of a woman was assaulted with a beer bottle causing him serious injuries.
3. Heard both sides.
4. The wound certificate of the victim shows that he was assaulted on the head. He sustained deep lacerated wounds near the right eyebrow and on the head. The prosecution allegation appears to be probable. This is not a fit case to grant anticipatory bail. In the result, the bail application is dismissed. Learned counsel for the petitioner submits that the
Bail Appl. No.2796 of 2015 2 petitioner will surrender before the investigating officer. He may do so if he is so advised.
