The Petitioner is alleged to have committed the offence under Sections 379 of Indian Penal Code and Sections 20 and 23 of Kerala Protection of River Banks and Regulation of Removal of Sand Act.

The prosecution case is that he used his vehicle to transport river sand without any permit or other authority.

5.

The petitioner is the owner of the vehicle in which river sand was transported without any permit. His custodial interrogation is necessary to know how it happened. Granting anticipatory bail will frustrate the investigation.
