O R D E R

Petition filed under Section 438 Cr.P.C.

2. Petitioner is accused in Crime No.439 of 2015 of Mulanthuruthy Police station. He was the Manager of the Kanjiramattam branch of the Keechery Service Co-operative Bank. The prosecution alleges that accused nos.1 to 3 pledged spurious gold and obtained huge amounts from the bank as loan. The petitioner was allegedly a party to the conspiracy. Thus they have committed the offences under Secs.120B, 406 and 420 of Indian Penal Code.

3. Heard both sides.

4. The petitioner had not been made an accused in the case till filing of the bail application. He was made an accused only later. The learned Public Prosecutor has no serious objection to his bail application. So I am inclined to grant him anticipatory bail.

In the result, the application is allowed.

Bail Appl. No.2893 of 2015 2 1) The petitioner shall be released on bail after interrogation on his executing a bond for Rs.1,00,000/- (Rupees One lakh only) with two solvent sureties each for the like sum if he is arrested by the Police in connection with this case.

2) He shall appear before the Investigating Officer for interrogation if he is so required by him in writing.

3) He shall not intimidate or attempt to influence the witnesses.

4) He shall not destroy or tamper with evidence.

In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with the law.
