O R D E R
Petition filed under Section 438 Cr.P.C.

Petitioners and first informant are partners of a firm. The petitioners apprehend that they will be arrested by the police on the allegation that they have committed the offences under Sections 406, 420, 468 and 471 of Indian Penal Code.

The prosecution case is that they misappropriated the money of the partners of firm and forged the signatures of the first informant in the minutes book and a letter.

It appears that this case is the result of the dispute among the partners of a firm. Custodial interrogation of the petitioners does not appear to be necessary for effective investigation. So I am inclined to grant the prayer of the petitioners for anticipatory bail. In the result, this application is allowed.

The petitioners shall be released on bail after
B.A. No.2896 of 2015 interrogation on their executing a bond for Rs.Twenty five thousand only each with two solvent sureties each for the like sum if they are arrested by the Police in connection with this case.

They shall appear before the Investigating Officer for interrogation if they are so required by him in writing. 3.
They shall not destroy or tamper with evidence.
4. They shall cooperate with the investigation and shall give the investigating officer their specimen signatures if necessary.
5.
They shall appear before the investigating officer on all Fridays for three months or rill the final report is filed whichever is earlier.
In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with the law.
