ORDER
Petition filed under Section 439 Cr.P.C.
2. Petitioner who is the 1st accused in Crime No.164 of 2015 of Nileshwaram Police Station is alleged to have committed the offences under Sections 323, 326, 498A, 506(1), 307 and 342 read with 34 IPC.
3. He was found to be in possession of 30 bottles of Indian Made Foreign Liquor which was meant for sale only in Karnataka. He has been in custody since 13.5.2015.
4.Heard.The application is opposed.
5. The police is seized 30 bottles of Indian Made Foreign Liquor from the petitioner. There is no dispute that it was meant for sale only in Karnataka. He is involved in other case under the Abkari Act. Prima facie, he has committed the offence.
