ORDER

Petition filed under Section 439 Cr.P.C.

2. Petitioner who is the sole accused in Crime No.28 of 2015 of Kumbla Police Station is alleged to have committed the offence under Section 55(a) of the Kerala Abkari Act.

3. He was found to be in possession of 30 bottles of Indian Made Foreign Liquor which was meant for sale only in Karnataka. He has been in custody since 13.5.2015.

4.Heard.The application is opposed.

5. The police seized 30 bottles of Indian Made Foreign Liquor from the petitioner. There is no dispute that it was meant for sale only in Karnataka. The petitioner is involved in an other case also under the Abkari Act. Prima facie, he has committed the offence. He is not entitled to anticipatory bail.
