Petition filed under Section 438 Cr.P.C.

Petitioner is alleged to have committed the offences under Sections under Sections 379 of Indian Penal Code and Section 20 and 23 of Kerala Protection of River Banks and Regulation of Removal of Sand Act.

The petitioner along with the co-acucsed was found transporting river sand in a vehicle without any valid permit or other documents.

The petitioner was the cleaner of a lorry in which river sand was being transported. The prosecution documents reveal that he is also involved in the case. There is a prima facie case against him.
