O R D E R

Petition filed under Section 439(1) Cr.P.C.

Petitioner is the second accused in Crime No.27/2015 of Badiakda Excise Range. He is alleged to have committed the offence under Sections 58 and 67(b) of the Kerala Abkari Act.

He was found transporting 60 bottles of Indian Made Foreign Liquor. It is submitted that he has been in custody since 28.04.2015 and he may be granted bail. 4.

Heard.

Having regard to the fact that he has been in custody since 28.04.2015 I am inclined to grant his prayer. His further detention is not necessary for completion of the investigation.

In the result, this application is allowed.

The petitioner will be released on bail on his executing a bond for Rs.25,000/- (Twenty five thousand only) each with two solvent sureties each for the like sum

B.A. No.2929 of 2015 to the satisfaction of the lower court concerned. 2.

He shall appear before the investigating officer between 10.30 a.m and 11.30 a.m on every Friday for three months, or till the final report is filed, whichever is earlier. 3.

He shall not intimidate or attempt to influence the witnesses, not shall he get himself involved in any other criminal case.

4.

He shall surrender his passport before the lower court concerned or if he does not have one he shall file an affidavit to that effect within five days of his release. 5.

He shall not leave India without the previous permission of the court of enquiry or trial court as the case may be.
