K. ABRAHAM MATHEW, J.

---------------------- Bail Appl. No.2950 of 2015 -------------------------------------------- Dated this the 29th day of May 2015

O R D E R

Petition filed under Section 439 Cr.P.C.

2. The petitioner is alleged to have committed the offence under Sec.306 of Indian Penal Code. The allegation is that he had illicit relationship with the victim and committed foul play, a result of which she was compelled to commit suicide.

3. Heard both sides.

4. Learned counsel submits that taking into consideration the period of custody he may be granted bail.

5. The suicide note of the victim shows that the petitioner had illicit relationship with her and he cheated her, which compelled her to commit suicide. His involvement is prima facie clear from the suicide note. He has been in custody only since 14.05.2015. The investigation is only at the preliminary stage. Releasing him on bail at this stage will hamper the investigation.

In the result, this bail application is dismissed. Sd/- K. ABRAHAM MATHEW JUDGE NS
