Petition filed under Sec.438 Cr.P.C.
2. Petitioner is the accused in Crime No.203 of 2015 of Vechoochira Police station. He is alleged to have committed the offence under Sec.420 of Indian Penal Code. He was the Manager of Valuthundiyil Financiers. In 2007 the 1st informant deposited Rs.75,000/- in his name and Rs.1,12,000/- in his wife's name. The petitioner had undertaken that if something goes wrong with the company he would sell his property and pay the amount. The company was closed down in 2009. The petitioner has failed to pay the amount.
3. Heard both sides.
4. The petitioner was only an employee of the company. Moreover it is doubtful whether the facts of the case would attract Sec.420 IPC. So I am inclined to grant the prayer of the petitioner.
In the result, the bail application is allowed.

1) The petitioner shall be released on bail after interrogation on his executing a bond for Rs.25,000/- (Rupees Twenty five thousand only) with two solvent sureties each for the like sum if he is arrested by the Police in connection with this case.
2) He shall appear before the Investigating Officer for interrogation if he is so required by him in writing.
3) He shall not destroy or tamper with evidence.
4) He shall not get himself involved in any other criminal case.
5) He shall not intimidate or attempt to influence the witnesses.
In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with the law.
