Petition filed under Section 438 Cr.P.C.
2. The petitioner along with the co-accused is alleged to have assaulted the victim with dangerous weapons and thus committed the offences under sections 143, 147, 148, 149, 323, 324, 308 of IPC and 24 of the Arms Act. The specific allegation against the petitioner is that he assaulted the first informant on the back with a handle of a sword. The other accused used iron rods.
3. Heard.
4. The wound certificate shows that the victim sustained injuries on the face, on the forehead and the left shoulder. It is clear that he was assaulted on the head. The petitioner was armed with a sword which shows his intention. The fact that he is a person who carries a weapon with him alone is sufficient to reject the prayer for anticipatory bail.
In the result, this application is dismissed. The learned counsel submits that the petitioner will surrender before the
