------------------------------------------- B.A.No. 3018 of 2015 ------------------------------------------- Dated this the 3rd day of June, 2015
ORDER
Petition filed under Section 439(1) Cr.P.C.
2.
Petitioner is the accused in Crime No.458 of 2015 of Hosdurg Police Station registered for the offences under Sections 376(1), (2) of IPC and Section 4 of the Protection of Children from Sexual Offences Act.
3.
The prosecution case is that he committed rape on a 16 year old girl.
4.
Heard.
5.
The case was registered on the basis of the statement given by the victim girl. Prima facie, the petitioner has committed the offence alleged against him. Merely because he has been in custody for about one month he cannot be granted bail. There is every likelihood of influencing or threatening the witnesses. So I am not inclined to grant his prayer.
In the result, this application is dismissed. K.ABRAHAM MATHEW JUDGE pm
