Petition filed under Sec.439 Cr.P.C.
2. Petitioners are accused in Crime No.499 of 2015 of Hill Palace Police station. They are alleged to have committed the offences under Secs.341, 323, 324, 326 and 307 read with Sec.34 of Indian Penal Code. The prosecution case is that they wrongfully restrained the victim and stabbed him with a knife in order to commit his murder. They have been in judicial custody since 05.05.2015.
3. Heard both sides.
4. There has been much progress in the investigation of the case. The petitioners have been in custody for one month. Their further detention is not necessary for completion of investigation.
In the result, the bail application is allowed.
1. The petitioners will be released on bail on their executing a bond for Rs.25,000/- (Rupees
Bail Appl. No.3066 of 2015 2 twenty five thousand only) each with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate concerned.
2. They shall appear before the investigating officer between 10.00 a.m and 11.00 a.m. on every Wednesday for three months, or till the final report is filed, whichever is earlier.
3. They shall not threaten or attempt to influence the witnesses, nor shall they get themselves involved in any criminal case.
4. They hall not destroy or attempt to destroy the evidence or interfere with the investigation. If the petitioners violate any of the above conditions, the court of enquiry/trial is empowered to cancel the bail in accordance with the law.
