O R D E R

Petition filed under Section 438 Cr.P.C.

Petitioner is alleged to have committed the offence under Sections 323, 324, 379, 452 and 506 of Indian penal Code.

The prosecution case is that at 9 in the night on the date of occurrence he trespassed in to the house of the first informant, a girl aged 17 years assaulted her and committed theft of a gold chain weighing 2 sovereigns and threatened to cause her death.

The learned counsel submits that the petitioner and the victim girl were in love which is evidenced by Annexure-A letter written by her and this is a false case got registered by her parents for the reason that they did not like their relationship. On the other hand, the prosecution version is that she jilted him and on account of that enmity he committed the offences. Annexure-A does not bare any date. The probability of the prosecution case being probable cannot be ruled out now.

The victim

B.A. No.3104 of 2015 sustained some injuries . Immediately after the incident she was taken to hospital. So there is a prima facie case against the petitioner.
