O R D E R

Petition filed under Sec.439 Cr.P.C.

2. Petitioner is alleged to have committed the offences under Secs.363, 366(A) and 376 of Indian Penal Code and Secs.3 and 4 of the Protection of Children from Sexual Offences Act. The prosecution case is that he kidnapped a girl aged 16 years and had sexual intercourse with her and thus committed the offences mentioned above.

3. Heard both sides.

4. The petitioner has been in custody since 01.04.2015. He is a 19 year old boy. His further detention is not necessary for completion of investigation. In the result, the bail application is allowed.

1. The petitioner will be released on bail on his executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties each for the like sum to the satisfaction of

Bail Appl. No.3117 of 2015 2 the learned Magistrate concerned.

2. He shall appear before the investigating officer between 10.00 a.m and 11.00 a.m. on every Wednesday for three months, or till the final report is filed, whichever is earlier.

3. He shall not threaten or attempt to influence the witnesses, nor shall he get himself involved in any criminal case.

4. He shall not destroy or attempt to destroy the evidence or interfere with the investigation. If the petitioner violates any of the above conditions, the court of enquiry/trial is empowered to cancel the bail in accordance with the law.
