Heard both sides.

Learned Public Prosecutor on instructions submits that at present the person who was allegedly driving the vehicle involved in the present case, is an identifiable person and as such, applicant herein is not arrayed as accused till now, by name. Investigation is still in progress. Hence merely based on an apprehension that he may be arrayed as an accused at a later point of time, bail cannot be granted to the applicant at this stage. Hence, the application is closed with liberty to the applicant to move at appropriate stage later.
