O R D E R

Petition filed under Section 438 Cr.P.C.

The Petitioner apprehends that he will be arrested by the police in Crime No.375/2015 of Kodungallur police station registered for the offence 420 of Indian Penal Code.

He was the owner of an immovable property.

He allegedly sold it to the first informant and later entered into an agreement for its sale in favour of a stranger. 4.

Heard.

The learned counsel submits that the first informant is a money lender from whom the petitioner had borrowed certain amount executing a sale deed as a security. It appears that this is essentially a civil dispute. Detention of the petitioner is not necessary. In the result, this application is allowed.

The petitioner shall be released on bail after interrogation on his executing a bond for Rs.25,000/- (Rupees Twenty five thousand only) with two solvent

B.A. No.3224 of 2015 sureties for the like sum each if he is arrested by the police in connection with this case.

He shall appear before the investigating officer for interrogation if he is so required by him in writing. 3.

He shall not get himself involved in any other criminal case while he is on bail.

4.

He shall not intimidate or attempt to influence the witnesses.

5.

He shall not destroy or tamper with evidence. In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with law.
