O R D E R

Petition filed under Section 438 Cr.P.C.

2. Petitioner is alleged to have committed the offences under sections 406, 465, 468, 497, 420 read with 34 of IPC. The first informant is her husband. The allegation is that she forged a cheque and withdrew Rs.40,000/- from the account of her husband and misappropriated it.

3. Heard.

4. The petitioner's case is that the husband had entrusted signed blank cheques to the petitioner and she did not forge the signature of her husband. Considering the relationship between the parties and the fact that even without detention of the petitioner the case can be investigated, I am inclined to grant the prayer of the petitioner.

In the result, this application is allowed.

1) The petitioner shall be released on bail after interrogation on her executing a bond for Rs.25,000/- (Rupees Twenty five thousand only) with two solvent

sureties each for the like sum if she is arrested by the Police in connection with this case.

2) She shall appear before the Investigating Officer for interrogation if she is so required by him in writing.

3) She shall not destroy or tamper with evidence.

4) She shall not get herself involved in any other criminal case while she is on bail.

5) She shall not intimidate or attempt to influence the witnesses.

6) She shall give her specimen signature and handwriting to the Investigating Officer, if necessary.

In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with the law.
