Petition filed u/s.439 Cr.P.C.

2. Petitioner is the fourth accused in Crime No. 530 of 2015 of Kollam East Police Station registered for the offence under sections 143, 147, 148, 294(b), 323, 324, 308 read with 149 IPC. The prosecution case is that at 7 p.m. on 07.03.2005 armed with deadly weapons like swords, he along with the co-accused assaulted the victim brutally.

3. Heard.

4. Learned counsel submits that the petitioner was not armed with any weapon. That will not mitigate the situation. He knew very well that the co-accused were armed with swords. He took part in the assault. The co-accused attacked the victim on head and other parts of his body with swords, causing him very serious injuries. The petitioner is involved in four other criminal cases. Granting him bail at this stage is not in public interest. In the result, this application is dismissed. Sd/- K.
