Petition filed under Sec.439 Cr.P.C.

2. Petitioner is the 3rd accused in Crime No.35 of 2015 of Sasthamcotta Police station. He is alleged to have committed the offences under Secs.55(a)(b), 55(D), 55(A) and 58 of the Kerala Abkari Act. He was the licensee of a toddy shop. 112.800 litres of toddy kept in his toddy shop was found adulterated. Moreover, 800 m.l. of spirit was seized from his toddy shop.

3. Heard both sides.

4. The application is opposed.

5. The offences committed by the petitioner are very serious. The documents relied on by the prosecution show that there are no reasonable grounds to believe that he has not committed the offences. The prayer for bail cannot be granted though he has been in custody since 21.05.2015.
