Petition filed under Sec.438 Cr.P.C.

2. Petitioners are accused in Crime No.303 of 2015 of the Kadakkavoor Police station. They are alleged to have committed the offences under Secs.143, 147, 148, 294(b), 308, 324 and 341 read with Sec.149 of Indian Penal Code. The prosecution case is that they formed themselves into an unlawful assembly and assaulted the victim with a chopper.

3. Heard both sides.

4.The wound certificate of the victim shows that he sustained a serious injury in the occipital region of his head. He sustained other injuries also. This makes probable the prosecution case that the petitioners assaulted him with a chopper. The incident happened at 8.30 p.m. in the night. It is not proper to grant them anticipatory bail.
