O R D E R

Petition filed under Sec.438 Cr.P.C.

2. Petitioner is the accused in Crime No.1822 of 2014 of Kilikolloor Police station. He is alleged to have committed the offences under Secs.498A and 306 of Indian Penal Code. The prosecution case is that he abetted his wife to commit suicide and as a result of it she committed suicide on 10.11.2014.

3. Heard both sides.

4. The deceased has not left behind a suicide note. The materials relied on by the prosecution as of now do not disclose commission of the offence under Sec.306 IPC. Having regard to these facts, I am inclined to grant the prayer of the petitioner.

In the result the bail application is allowed. i) The petitioner shall be released on bail after interrogation on his executing a bond for Rs.25,000/- (Rupees Twenty five thousand only) with two solvent sureties each for the like sum if

Bail Appl. No.3272 of 2015 2 he is arrested by the Police in connection with this case.

ii) He shall appear before the Investigating Officer between 10 a.m. to 11a.m. on every Thursday for two months or till the final report is filed whichever is earlier.

iii) He shall not destroy or tamper with evidence.

iv) He shall not intimidate or attempt to influence the witnesses.

v) He shall not get himself involved in any other criminal case.

In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with the law.

If the investigating officer collects any evidence to show that the petitioner has committed the offence under Sec.306 IPC he may apply for cancellation of bail. K. ABRAHAM MATHEW JUDGE NS
