Petitioners are alleged to have committed the offences under Sections 341, 323, 325 and 326 read with Section 34 of Indian Penal Code.

The prosecution case is that they assaulted the victim with dangerous weapons causing him serious injuries.

Heard.

The earlier application filed by the Petitioners was dismissed. The second application has been filed on the allegation that in fact the first informant did not sustain any fracture and the dismissal of the earlier application on the ground that there was fracture is wrong. The statement of the doctor who treated the first informant shows that there was a fracture of nasal bone and it could be caused with a weapon. So the ground on which the second application is filed is not actually available.
