ORDER
Petition filed under Section 439 Cr.P.C.
2.Petitioner is the sole accused in Crime No.28 of 2015 of Kumbla Police station. The petitioner is alleged to have committed the offence punishable under Section 55(a) of the Kerala Abkari Act I of 1077. The prosecution case is that, he was found transporting 30 bottles of Indian Made Foreign Liquor each containing 180 ml, which was intended to be sold only in Karnataka.
3.The learned counsel submits that taking into consideration the period of custody, he may be granted bail.
4.Heard both sides.
5.The petitioner has been in custody since 13.05.2015. The application is opposed especially on the ground that
B.A.No. 3276 of 2015 the petitioner has been involved in another case under the Abkari Act. There are no sufficient grounds to believe it that he is not guilty of the offence. I also find no reason to believe that he will not commit the offence again.
