O R D E R

Petition filed under Section 438 Cr.P.C.

2. Petitioner is alleged to have committed the offences under Sections 323, 341, 354 and 506 IPC. The prosecution case is that he wrongfully restrained the victim, threatened and assaulted her and outraged her modesty.

3. Heard.

4. Admittedly, no weapon was used. Having regard to the nature of the allegations, it is doubtful whether Section 354 IPC is attracted. So, I am inclined to grant the prayer. In the result, this application is allowed.
