Petition filed under Section 438 Cr.P.C.

Petitioner apprehends that he will be arrested by the Feroke police in connection with the Crime No.529/2015 of Feroke Police Station registered for the offences under Section 379 of Indian Penal Code and Section 20 and 23 of Kerala Protection of River Banks and Regulation of Removal of Sand Act.

The learned Public Prosecutor submits that the petitioner is not arrayed as an accused, but the name of an offender is yet to be ascertained. In these circumstances this bail application will be dismissed, but if the petitioner is made an accused, he may file a fresh application. In the result, this application is dismissed with the above observation.
