Petition filed under Section 438 Cr.P.C.

Petitioner is alleged to have committed the offences under Sections 143, 147, 341, 323, 332 and 427 read with Section 149 of Indian Penal Code.

The prosecution case is that two police constables were patrolling the area in which the offences allegedly committed on a motor cycle in civil dress; when they noticed certain people consuming liquor at a public place the police officers disclosed their identity and questioned the persons who were consuming alcohol. The petitioner along with the other persons assaulted a police officer and tore off his shirt.

It is very strange that the petitioner who himself is a police officer assaulted the police officers who were in civil dress for the reason that they questioned other persons consuming alcohol at a public place. The

B.A. No.3336 of 2015 petitioner had no personal interest in the matter still he supported the persons who were consuming alcohol at a public place. He did not do justice to his uniform. This is not a fit case to grant anticipatory bail.
