O R D E R

Petition filed under Sec.438 Cr.P.C.

2. Petitioner is the 2nd accused in Crime No.92 of 2015 of Irinjalakuda Police station registered for the offences under Secs.308, 323, 324 and 341 of Indian Penal Code. The prosecution allegation is that he along with the co-accused wrongfully restrained the 1st informant and assaulted him with a steel ring causing him serious injuries.

3. Heard both sides.

4. Learned counsel for the petitioner submits that the petitioner lost his right palm in an accident, in support of which he has produced Annexure 3.

5. Learned Public Prosecutor submits that the petitioner is involved in several cases, one of which was registered for the offences including the one under Sec.308 IPC.

6. The 1st informant sustained four lacerated

Bail. Appl. No.3354 of 2015 2 wounds on the scalp. It appears that the prosecution case is genuine. The antecedents do not justify granting anticipatory bail to the petitioner.

6. The learned Magistrate may take notice of his condition if he happens to file an application under Sec.437 Cr.P.C.

With the above observations, the bail application is dismissed.
