Petition filed under Sec.438 Cr.P.C.

2. Petitioners are accused in Crime No.30 of 2015 of Edacherry Police station registered for the offence under Secs.143, 147,148, 427, 436 and 448 read with Sec.149 of Indian Penal Code. The prosecution case is that, at 10.30 p.m. on 23.01.2015 they set fire to a relief centre after trespassing into it causing damages to the tune of Rs.70,000/-

3. Heard both sides.

4. Learned counsel submits that there is nothing to show that the petitioners are involved in the incident.

5. It is true that their names do not find any place in the First Information Statement. But in the statement recorded under Sec.161 Cr.P.C. their names are disclosed. So it cannot be said that there is no prima

Bail Appl. No.3429 of 2015 2 facie case against the petitioners. The offences alleged against them are very serious. Granting anticipatory bail to them will frustrate the investigation.

In the result, the bail application is dismissed. Learned counsel submits that the petitioners will surrender before the investigating officer. They may do so if they are so advised.
