Petition filed under Section 438 Cr.P.C.

Petitioners are alleged to have committed the offences under Sections 308, 324 and 341 of Indian Penal Code.

The prosecution case is that the first petitioner wrongfully restrained the victim and assaulted him with a chopper and the second petitioner assaulted him with an iron rod. In the incident the victim sustained serious injuries on his head.

Heard.

The doctor noticed fracture of the left parietal bone of the victim. Contusion on the frontal lobe also was noticed by the doctor. The injuries make probable the prosecution case against the petitioners. The attack was on the head. The injuries were serious. The weapons have not been recovered. In these circumstances it is not
