Petitioner is alleged to have committed the offence under Section 379 of Indian Penal Code read with Sections 20 and 23 of the Kerala Protection of River Banks and Regulation of Removal of Sand Act, 2001. The prosecution case is that he was found transporting river sand in a lorry without any permit or other authority.

Petitioner was the driver of the vehicle in which the river sand was being transported. Admittedly, it had no permit. Prima facie, he has committed the offence alleged against him .
